Alternative Dispute Resolution

Collectively, arbitration and mediation are referred to as alternative dispute resolution, and are often preferable substitutes for litigation in construction law cases. When parties take a case to trial, they run the risk of prolonged resolution or an unfavorable judgment from a judge or jury. Contractors and subcontractors may not get what is due to them immediately, and enforceable legal actions are at the whim of an overburdened court. With arbitration and mediation, parties resolve their disputes in a private manner in less time, and is less formal than a courtroom.

Arbitration

With arbitration, a single arbitrator or a panel of arbitrators hears evidence and decides on the merits of both parties’ claims. The results of an arbitration are legally binding. Despite the finality of the decision, it is still a shorter process, it’s less formal, and is less drawn out than a trial.

Mediation

With mediation, a mediator does not hear evidence, issue orders, or decide on the merits of a case. Rather, mediators are a neutral third party that facilitates the discussion and resolution of a case. The mediator can develop alternate solutions and help parties reach a settlement.
