Arbitration & Mediation

We Help You Pick the Right Strategy to Resolve Your Dispute

How Our Experience Can Help You

Michelson, Kane, P.C. offers mediation and arbitration services for all of your construction, labor/employment, and municipal/public utilities law disputes. Not only can we prepare and advise you for an upcoming arbitration or mediation, but we also act as arbitrators and mediators ourselves. We know the process well, so you know you are in good hands.

In fact, our own Steven Kaplan  is one of only two Master Mediators on the AAA Construction Mediation Panel for Connecticut. He has been an Arbitrator and Mediator for construction disputes for nearly thirty years, and he is ready to put his experience to work for you.

Alternative Dispute Resolution

Collectively, arbitration and mediation are referred to as alternative dispute resolution, and are often preferable substitutes for litigation in construction law cases. When parties take a case to trial, they run the risk of prolonged resolution or an unfavorable judgment from a judge or jury. Contractors and subcontractors may not get what is due to them immediately, and enforceable legal actions are at the whim of an overburdened court. With arbitration and mediation, parties resolve their disputes in a private manner in less time, and is less formal than a courtroom.

With arbitration, a single arbitrator or a panel of arbitrators hears evidence and decides on the merits of both parties’ claims. The results of an arbitration are legally binding. Despite the finality of the decision, it is still a shorter process, it’s less formal, and is less drawn out than a trial.

With mediation, a mediator does not hear evidence, issue orders, or decide on the merits of a case. Rather, mediators are a neutral third party that facilitates the discussion and resolution of a case. The mediator can develop alternate solutions and help parties reach a settlement.
